The rights to the source code is in the hands of Ubisoft (whether they actually have it is another matter).

People have tried to ask Ubisoft to release the source code of their Jade Engine (used by Beyond Good and Evil, Sands of Time etc), and Ubisoft said they would not consider releasing any source code. So there isn't much hope.
