I'm sure the question about the legality of Pocket Heroes game is too complicated to describe it with one phrase (legal/illegal), i.e. 3DO is bankrupt, but Ubisoft hasn't bought the right to HoMM2 content. I've contacted with Ubisoft some months ago, and only thing they want is to close PocketHeroes...
